These Terms govern the use of PearDrop website, web client and related native apps.

2. Scope
These Terms apply to all use of PearDrop services, including invite links, web client usage, and native app usage.
3. Service Description
PearDrop enables invite-based peer-to-peer file transfer and related download/install pages.
- Service availability may change and is provided on a best-effort basis.
- Certain features may depend on third-party infrastructure (hosting, relay, app stores).
4. User Responsibilities
- You are responsible for the content you share through PearDrop.
- You must only use the service lawfully and respect third-party rights.
- You must not upload, share or distribute malicious, infringing or illegal content.
- You should treat invite links as confidential access tokens.
5. Intellectual Property
PearDrop software, branding and related materials are protected by applicable intellectual property law unless otherwise stated.
6. Service Availability and Changes
We may modify, suspend or discontinue features for technical, security or legal reasons. We may also update these Terms when required.
7. Disclaimer of Warranties
The service is provided “as is” and “as available”. To the maximum extent permitted by law, no warranties are made regarding uninterrupted availability, fitness for a specific purpose, or complete error-free operation.
8. Limitation of Liability
We are liable without limitation for intent and gross negligence. For slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damages. Mandatory statutory liability remains unaffected.
9. Indemnification
You agree to indemnify and hold harmless the provider from claims arising from unlawful use of the service or violation of third-party rights by content you share.
10. Termination
You may stop using the service at any time. We may restrict or terminate access where necessary for legal, security or abuse-prevention reasons.
11. Governing Law and Jurisdiction
German law applies, excluding UN sales law (CISG), to the extent legally permissible. If legally allowed, the place of jurisdiction is Schriesheim, Germany.
12. Severability
If any provision of these Terms is invalid, the remaining provisions remain unaffected.
